Sunni Husband's Shia wife can't share in Property, Petition filed in Supreme Court

ISLAMABAD: A two-member bench of the Supreme Court headed by Justice Qazi Faiz Issa has adjourned the hearing of a case related to the share of a Sunni husband's agricultural property to a Shia wife for an indefinite period and issued notices to the parties. 

Qazi Faiz Issa inquired as to where it is written that if the wife is a Shia then She cannot be entitled to agricultural land of her Sunni husband.

Lawyer for the petitioner took the position that according to the Shia sect, if the husband is Sunni and the wife is Shia, then the wife cannot  gets share in the agricultural land. 

According to the decisions of the Supreme Court, if the husband is Sunni and the wife is Shia, then the property will be transferred on the principle of Shia sect. According to Shia sect. If they do not have children, the wife cannot have a share in the agricultural property on the death of her husband.

It should be noted that on the death of her Sunni husband 20 years ago, her Shia wife Talib Bibi got a share of agricultural land. The nephew of the late Sunni husband had filed a case against Talib Bibi after receiving the property.
